Terms of service

Who you’re buying from. FacilitySurplus.com is operated by Facility Surplus (“we,” “us”).

What we sell. We sell new, unused surplus and overstock products for commercial buildings and facilities. That includes HVAC equipment, electrical and lighting products, plumbing and restroom fixtures, pumps, motors and fans, and janitorial and maintenance supplies. Unless a listing says otherwise, every item is:

  • new and has never been installed or used, and
  • in its original manufacturer packaging.

Product photos may show the model in general, not the exact unit you receive. Surplus stock can be older than what’s on store shelves today but that's the whole reason you are here, right? If the age of an item matters to you, ask us before you buy.

Manufacture dates. For items where the manufacture date matters, such as HVAC and plumbing equipment, we will email you a photo of the manufacturer’s label showing the date if available. We will only send it if you specifically request it and only after your payment is authorized but before we ship. If you don’t accept the date, tell us and we’ll cancel the order. Your card won’t be charged. Locating the item, taking the photo and sending it to you will delay the process so be prepared to wait and understand that we cannot make exceptions to this policy.

We are not an authorized dealer or manufacturer’s representative. Facility Surplus is not affiliated with, endorsed by, or an authorized dealer for any manufacturer whose products we sell. We use brand names and model numbers only to identify the product.

Manufacturer warranty.

  • We do not provide any warranty of our own.
  • We can’t promise that the manufacturer will honor its warranty on a product bought from us. Many manufacturers require you to buy through an authorized seller, have the product installed by a licensed or certified professional, register the product, or all three.
  • Check warranty eligibility with the manufacturer before you buy.
  • Any warranty coverage is strictly between you and the manufacturer.

What’s not included. Each purchase covers only the item listed. We do not provide:

  • installation, start-up, commissioning, wiring, piping, or system design
  • technical support or troubleshooting
  • extended warranties or service plans
  • parts, fittings, wiring, mounting hardware, controls, or accessories that the listing doesn’t mention

Sold as-is. Except as stated in our Return, Refund & Damage Policy, all sales are final and products are sold AS-IS, WITH ALL FAULTS. To the fullest extent the law allows, we disclaim all implied warranties, including the implied warranties of merchantability and fitness for a particular purpose. Some states don’t allow implied warranties to be disclaimed on consumer purchases. If you live in one of those states, implied warranties apply only to the extent and for the shortest period the law requires.

Your responsibility for codes and regulations. You are responsible for confirming that what you buy is right for your project and can legally be installed or used where you are. That includes:

  • local building, mechanical, electrical, plumbing and fire codes, plus any permits and inspections
  • licensing rules: many products must be installed by a licensed electrician, plumber, or HVAC contractor
  • compatibility with your site, such as voltage, phase, amperage, pipe size, connection type, and space requirements
  • listing and certification requirements your inspector may enforce, such as UL or ETL listing, or NSF/ANSI lead-free certification for plumbing products that touch drinking water
  • state and federal energy and water efficiency rules that limit what can be installed in some areas (for example, certain lighting, plumbing fixtures, and water heaters)
  • EPA and state refrigerant rules for HVAC equipment, including installation deadlines and state-specific restrictions on R-410A, R-32, and other refrigerants
  • safe handling, storage and disposal of chemicals, cleaning products, batteries, and lamps that contain mercury

Limitation of liability.

  • Our total liability for any claim related to an order is limited to the amount you paid for the item involved.
  • We are not liable for installation costs, labor, lost profits, downtime, or other indirect or consequential damages.

Pricing and availability.

  • Quantities are limited. Items are not reserved for you until your payment is complete.
  • If an item turns out to be unavailable or was listed at the wrong price, we may cancel the order and give you a full refund.
  • Items marked Special Order are not kept in stock. We confirm availability and lead time after you order. If we can’t supply the item within the lead time we quote, you may cancel for a full refund.

Payment disputes. If you have a problem with your order, contact us first at orders@facilitysurplus.com and we will work with you to fix it.

  • By ordering, you agree to give us a reasonable chance to resolve the issue before you dispute the charge with your card issuer.
  • If you do file a dispute, we’ll respond with your order records, delivery records, and your acceptance of these terms at checkout.

Governing law. These terms are governed by the laws of the State of Wyoming.
